Research Into EU Green Trade Barrier Study From Its Reasonability And Unreasonability

With the development of economic globalization,the international trade on China's economic development plays an increasingly important role.Recently,the economic relation between China and EU has a fast development.EU has become the biggest trade partner of China.With the rapid growth of trade between EU and China,conflicts between trade liberation and environmental protection become much more evident,and environmental barriers occur more frequently.It has a lot of environmental standards blocking our export.It has more impact than anti-dump as the biggest challenge.In the new trade barriers have a special status as China's export trade one of the greatest challenges. Though the green barrier is called "barrier",it can be divided rational and Unreasonable.But the fundamental spirit of WTO Competition Policy is to keep competes fairly and freely,it opposes the unreasonable green barrier that restricting fair competition certainly,but it approves rational green barrier.The green barriers of EU are not directed against our developing countries,these green barriers are all not irrational, its judge basis of rationality are the provision of the article 20 of GATT and WTO competition policy.Meanwhile,deep and object analyzing the legal relation of the green barrier of EU and WTO competition policy, will contribute to treat the green barrier of EU correctly,handling the green barrier of EU.The thesis analyzed from four parts.The first part analyzed the general situation and double nature of the green barriers;The second part analyses EU green barriers posed system and the impact on China including two aspects:negative and positive ones.EU green trade barriers have hindered the development of China's foreign trade,but every coin has its two sides.Green trade barrier of EU brought challenge and precious opportunities meanwhile.It will accelerate Chinese environment protection standard getting close to international standard and Chinese companies concentrating on designing green products.The third part discusses China must correctly evaluate the EU green barriers of reasonable and unreasonable.Chapter 4 is devoted to the study of countermeasures of China to deal with green trade barrier.As one of the developing countries,China suffers a lot from green trade barrier. However,China has to face its challenge and break through its negative effects,and establish China green trade barrier system.
