Analysis On The Endowment Insurance Systems In Japan And China In The View Of Law Sociology

Endowment insurance legal system is the most important measure for government in promoting the life-security of elderly. The development history of the endowment insurance in developed countries indicates that perfect legal system would guarantee the benign evolution of the endowment insurance system. The endowment insurance system of Japan, started with the first annual insurance law in 1941, progressed to be one of the developed social endowment insurance legal systems in the world. The endowment insurance system in China, which was established in 1997, need to be perfected in system and its implementation. The thesis aims at bring forward perfecting proposals of China's endowment insurance system, by analyzing the differentia and the causes to the differentia between the two systems in Japan and China with comparison.The first one of the four parts of the thesis compares the endowment insurance legal system in Japan and China. First of all, it introduces the diversified evolution history of the two systems. Second, it illustrates the differentia between the two systems, and specifies the advantages of Japan's system and the deficiencies in the system of China.The second part analyzes the endowment insurance systems in Japan and China with comparison sociology. Comparing the diversities in the two systems, the thesis studies the causes to the diversities with comparison sociology, from which the differentia of the two systems is come into being due to the differences in politics, economy, culture and legislation concept of the two countries.The third part introduces the advantages of Japan's endowment insurance legal system. On the basis of its unique background of economy, politics and culture, Japan established an endowment insurance system with perfect legislation and sound management and surveillance mechanism, which also drives family-aged-support and community-aged-support to function favorably. The forth part proposes the perfection suggestion on endowment insurance legal system in China. Analyzing the problems existed and deficiency of China's endowment insurance system, the thesis proposes to draw experience from Japan's endowment insurance system for reference and to integrate the present situation of the endowment insurance system in China, so that the legal system regulating endowment insurance in China could be constructively established, and the benign management and surveillance mechanism could be founded, and the family-aged-support and community-aged-support could also function reasonably.
