Research On The Effects Of Environmental Trade Measures On The Agricultural Trade Of China And The Countermeasures

In 1995,with the establishment of the World Trade Organization,the international trade became more standardized and open.Traditional forms of trade protection,such as tariff barriers,subject to stricter control in the trade pattern. However,this does not mean that the world market opens fully accessible.On the contrary,along with the emergence of environment wave in the 21 st century,the environmental trade measures have become the sword trade protection.Agriculture is dependent on the environment highly,so the environmental trade measures pay a important role in world agricultural trade.Adopted some theory analysis and comparative research,the thesis expands the recognition toward environmental trade measures of agricultural products in term of law,and makes some references to perfect China's legislation.The thesis is divided into four parts:The first part starts from the concept of environment trade measures and agricultural products,clearly defines environmental trade measures of producer, analyzes its character,and introduces the history and reasons of environmental trade measures of agricultural products.This part also proves the theory basis of the environmental trade measures of agricultural products from international environmental law,sustainable development,the common heritage of human property rights,the right of giving priority to the development of developing countries,and the economic point(internalization of environmental costs and international capital element of cross-border transfer),and lays basis for understanding the environmental trade measures of agricultural products properly.The second part compares the measures taken by different countries(such as the USA,Japan,EU,South Korea,Australia,New Zealand and the North American Free Trade Area) during the implementing concrete the environmental trade measures of agricultural products.In accordance with the administer institutions,laws,technical standards,this part particularly pays attention to the characteristic system,such as FDA of the USA,Japan's Positive List System and JAS standard agroforestry system, The EU's GMO regulations and the new Food Safety Law,South Korea's special provisions affected areas.China and the Australia-New Zealand bilateral trade of agricultural products in general is not plentiful.However,in 2008,because of the problem milk powder incident,we need to study the produce and trade of milk products in both Australia and New Zealand.By analyzing environmental trade measures of agricultural products in the FTA of Australia-New Zealand and Zealand - Thailand, the thesis points out the developing direction of China milk products trade. NAFTA is chosen because the environmental trade measures of agricultural products of the NAFAC are more transparent.Today the current global financial tsunami has affected the substantial economy.The new trade protection gradually prevails.With the stagnation of the Doha negotiations of WTO,FTA is becoming more applicable. Therefore we may be enlightened by the environmental trade measures of agricultural products of the NAFAC.The third part analyzes of environmental trade measures on China's status quo, including the general situation of the country,the situation in different provinces in trade,all kinds of market subjects,as well as sub-species of agricultural trade.The essay pays attention to the environmental trade measures of Aquatic products, vegetables,honey,tea,nut and livestock products.And then this part introduces the implementation of the environmental trade measures of agricultural products in China Meanwhile,it points out the weakness of the measures:incomplete legal system, lacking of relevant international rules,poor Micro-operability and so on.Finally the thesis analyzes the environmental trade measures of agricultural products in both positive and negative aspects.The fourth part points out the foundation observed,and puts forward to some suggestions of strengthening measures from the view of national and international ways.
