Under the sweeping of economic globalization and tide wave of environmental protection, trade and environment are connected together and impact on each other. On one hand, free trade and environmental protection reinforce each other and are all the objectives of international community. On the other hand, there are contradictions between them, which caused the trade and environment issues and embody in the arguments between the environmentalist and the freetrader, between the developed countries and the developing countries. The issues also influence the WTO in the far-reaching manners. Environment-related cases in the WTO Dispute Settlement Body (DSB) have being increased and some relevant rules of WTO are in dispute.In recent years, as one of the countries where economy is developing actively, China has also been bothering by trade and environment issue. Rapidly increasing trade has caused some unfavorable effects on our environment, while our trade is suffering from the frequent encounter of environmental barriers.This thesis attempt to apply theoretic analyzing method and demonstration analyzing method to discuss the relationship between trade and environment, research legal rules in WTO treaties and relevant cases, analyze the emergence and appearance of trade and environment issues in WTO legal system, and then bring forward the resolutions, finally point out the measures China should take in regard to the status in China.The body of this thesis can be divided into five chapters. The first chapter discusses the relationship between trade and environment, especially the contradictions between the two aspects and the root cause of the contradictions. The discussion establishes a theory base for the following contents.The second chapter is about the relevant rules and principles of WTO.
