| In China, during the development of economy, the level and speed of urbanization is very important to the economy. The city land is both one of the important elements of urbanization and the carrier of the running of city economy. With the acceleration of urbanization, the city population and land increase steadily. All kinds of development districts and industrial areas are springing up. The need of city land is more and more great. During the development of city, city land is mainly transformed from country and is run by the local government. So the benefits of peasants, users of land, the country economic organizations local government, central government, etc. are involved in the use of city land. The followings are the main contradictions between them: the system of compensation to those peasants is not very perfect, which hurts the benefit of them greatly. The property right of the nation to city land cannot be realized in economy. The owner, managers and users of city land profit from their own land which leads to the fact that the transaction of land doesn't conform to regularity; the price of transaction is twisted; the regularity of land market has been troubled.The author believes that right and benefit integrates closely. In China, the city land is owned by the nation is in conformity with the development of economy. The key is the realization of system is not fit to the development. The realization of the system is the practice of the rights of all sides. So, in order to change the negative effects of the realization of the system, we should begin in solving the drawbacks of distribution system of city land. In the first part of the paper, firstly, the present paper analyzes the nature of benefit distribution system of city land, make clear the right of all sides which include the country economic organizations and peasants. In the requisition of land, the benefit of both sides should be protected. Secondly, when sell the right of land use, the central government, the local government and the user of city land should get the benefit as the owner, the manager and the user.In the second part, the paper analyzes the change of the system of benefit distribution of land city. From the historic point of view, we can see that in different historic periods, there are different city lands using systems. So, when the present system of benefit distribution of city land is not fit to the economic development, the need of reform arises. Then we compare the system of benefit distribution of city land to other countries'. We compare to different links of other countries' systems of benefit distribution of city land, and illustrate the successful experience of some development countries and regions. This successful experience can be used to help build our new system of benefit distribution of city land.In the third part, we analyze the problems in our present system of benefit distribution of city land from reality and the system itself, and point out that only from the root, the reform of the system of benefit distribution of city land, the problems can be resolved.In the fourth part, the present paper puts forward the new structure of the system of benefit distribution of city land in urban expansion. The new system takes into account the benefit of all relative sides, from peasants, country economic organizations to central government, local government and land users. All of them can get their own benefit according to their rights. And we prospect the future and analyze the effect of the new system of benefit distribution of city land. The new system is beneficial to the harmonious development and can solve the present problems. |
