Study On Business Method Patent Strategy In Chinese Underwriting

There are serious problems in underwriting ,for example :many insurance products are same in essence, the impetus for insurance innovation is weak. The reasons that restrict the innovation of Chinese insurance industry :For the moment ,there are less efficient legal methods to protect the intellectual production in insurance innovation. After estimating the laws and codes both in China and overseas , this article indicates that business method patent is a powerful means in protecting innovative product and service in insurance. Deep study on the business method patent layout and characteristic ,has an important practical impact on Chinese underwriting coping with foreign insurance firms.According to china patents database, this article generalizes the characteristics of insurance business method patent in China from three parts of applicant, application date, patent IPC. This article analyzes the traits of insurance business method patent in four fields: insurance product designing, insurance operation developing, insurance premium payment, information system. According to insurance business method patent situation, this article summarizes traits of insurance business method patent: carrying out insurance product and business method by computer hardware and software technology.The purpose of analyzing insurance business method patent characteristic ,at last is to provide worthy suggestions for Chinese underwriting. Finally, combined with the situation of insurance business method patent, this article brings forward the four measures for Chinese underwriting to copy with patent competition: firstly, establishing insurance patent product R&D mechanism; secondly, taking patent purchase strategy; thirdly, adopting basic patent strategy; fourthly, introducing patent portfolio strategy.Emphasizing on patent strategy in underwriting and research on underwriting how to use patent strategy to improve product ,are both the core and innovation of this article.
