It is not in force but the information they contented doesn't change, although there are lots of reasons to lose patent right, but not in force is not valid, not in force patents have wide applications just like patent, however, our country faced with this repository of information but does not have a dig way.This paper mainly has six parts:The first part shows the current use of not in force patents in China the feasibility and necessity, and research and utilization of not in force patents at home and abroad were introduced, make a major research paper.The second part, in summing up the results based on previous research and the relation information about other country combines a not in force patent's definition, and from the loss of monopoly rights summarized the causes for the production of not in force patent, summarizes Seven Country and Two Organization's website of their patent data bases, shows judgments of the not in force patent by the legal status, and introduce a number of unofficial sites and proprietary information retrieval part of the patent analysis software. Finally, this article analyzed the phenomenon of infringement in the application of not in force patents and proposed solutions.The third part, referred to in the first chapter, there are a huge number of not in force patents, how to eliminate the false and retain the true in application of the not in force patent is difficult.
