The Study On The Vicissitude And Its Law Of New China's Rural Land Property Right System

Rural land is the main means of production of agriculture. Giving full play to productive potential of rural land needs scientific rural land property right system to guide and regulate. The rural land property right system has made a significant contribution to New China's socialist construction. But with the further development of China's economy and society, the current rural land property right system also appears more and more problems, thus it needs the further reform to resolve the contradiction of productive relations on the rural land. Guided by Marxist land property right theory, the paper also imbibes useful elements of western property right theory to study. Through applies the comprehensive methods of materialist dialectics,field investigation,combination of empirical and normative analysis and others, with time as the main line to review the history of vicissitude of New China's rural land property right system, as the standard of rural land property right to divide the phases of the New China's rural land property right system vicissitude, analyses the feature and actual effect of the various phases, the paper summarizes the law of vicissitude of New China's rural land property right system to give guidance to reform the current rural land property right system of China. Following law, on the basis of development of economy and society, the paper divides the rural area of mainland China into three categories: the rural area of more developed region,the rural area of moderate developed and less developed region where there have lots of migrant working farmers and few rural resident,the rural area of moderate developed and less developed region where there have few migrant working farmers and lots of rural resident. Taking the factors that affect stability and development of three-categories rural area into synthetic consideration, the paper regards the circulation of rural land contracted management right as the breach to perfect the current rural land property right system, to solve the existing problems of rural land and to promote harmonious development of the urban and rural area.
