Study On Farmland Use Regulation In China

China is a great country of traditional agriculture, with the urbanization process accelerating, urban scale out spreading and construction land demand constantly rising, lead the area of our farmland to decreased, and the per capita cultivated land falls to average about 40% of the standard of the world. The breaks the law in the land of local government are increased, the examining and approving of farmland transference is confused, the waste of farmland is serious, all of this has caused highly importance of the party Central Committee and State Council, and puts forward resolutely to guard " 1800 million mu of red lines of cultivated land ", and strengthens land use regulation.The new Land Administration Law in 1998 carries out land use regulation system, and this has provided the law basis for land use regulation. However, scholars are more concentrated on the frame of land use regulations and very few people devoted to studying the problems and countermeasures in the regulation of farmland use change. As such, this paper uses the theory of government regulation, analyzes the present situation that farmland use regulation used in our country completely. There are some problems, such as the regulator transposition; seeking-rent; the law of punishment is not clearly and definitely. Investigating its reason, farmland protection policy itself is not to be imperfect, the policy execution is not to be strengthened and the legal system is not perfect. Then put forward some proposals, we should prefect the policy system in farmland protection, enforce the supervision of the local government farmland regulation, confirm property rights, perfect land administration system and the law about the overall land use planning.
