The Research On Legal Countermeasures For Control And Prevention Of Haze Weather

Since 2012, the serious haze weather in our country, affected the most cities in China and nearly six hundred million people, has caused widespread attention at home and abroad. And with the constant improvement of the understanding of haze weather, the research of haze has made certain progress, and scientific monitoring results have also answered the cause of haze and pollution problems. Governance of haze, especially since 2012, has made great progress and a significant breakthrough, such as further improving the related legal laws and regulations, further expanding information disclosure and public participation, the government also attached great importance to governance of the haze, the public and social groups also actively joined in prevention and control of the haze, it is an unprecedented "full action to cure haze". Meanwhile, there are more problems gradually exposed. In this background, this article through the study of the status quo of the haze governance, draw lessons from the advanced experience of developed countries, in order to put forward the legal countermeasures of the haze.This paper mainly divided into the following several parts. The first part is the introduction, this part narrates the selected topic background, significance, main research contents, research methods and so on, which is the starting point of the full text research. The second part is the summary of haze weather, it introduces the related concepts of haze weather, harm, the cause and the main pollution source of the haze. The third part is introduction and reference of law construction experience of the haze control abroad, mainly selected the United Kingdom and the United States, these two countries in the history have happened famous smoke pollution incident, although the pollution types are not exactly the same as in China, there are still worth learning on the management of legal system construction. The fourth part is the current situation about the haze control in our country, especially since 2012. The laws and regulations, the information disclosure has obtained certain achievements, but some problems still exist, such as backward idea of haze governance, single policy tools, imperfect laws and regulations, lack of environmental responsibility, energy structure adjustment in trouble and imperfect information disclosure. In the fifth part, combining with the developed countries governance legal experience, aiming at problems put forward relevant suggestions in treatment of haze. To control haze pollution, first of all we need change the idea of haze governance, flexible use of various policy tools, improve the existing legal system, as well as effectively implement the environmental responsibility, adjust the energy structure, and finally, perfect the information disclosure to make information more openly and safeguard citizens’ right of participation and supervision.
