World Expo Participation Contract With A Number Of Legal Issues,

Even 'The World Exposition' has experienced more than three hundreds years worldwide, it is regarding as a brand new concept existing in the mainland China. The Participation Contract, which refers to a legal document that determines detailed obligations and rights between both the organizer and the participants of the exhibition, plays a recognizing role in formally confirming the legal relationship of the identified parties.This thesis aims to thoroughly describe the Participation Contract in the World Exposition in five parts. Initially, the concept and characteristics of the Participation Contract will be introduced based on the exhibition background in the first chapter. This part highlights the distinguishing governmental nature of the Participation Contract in terms of special legal document within the scope of international laws. The second part emphasizes the whole contract structure and the authorizing signing entities of the identified contract. It mainly analyzes the original purposes of the document setting and the latest entire contract structure. In the third part, an in-depth description of the main contents in the contract will be illustrated with discussion of the possible legal issues. Based on the order of the contents, several key issues will be mentioned including the admission of the exhibition items/materials and the participants, the allocation of the sites and pavilions, general services and the organizer, the assistance to the developing countries and the settlements of disputes etc. Several important key legal issues regarding the customs, intellectual property, taxation and insurance etc. will be discussed systematically in the next part. Finally, some recommendations related to the World Exposition arrangement (e.g. preparation, organization, operation and management) will be provided according to the pervious comprehensive discussion of the legal specification of the Participation Contract.This thesis endeavors to clearly turn to the attempt of answering two basic but very important questions: What is the Participation Contract and How does the Participation Contract's legal meaning and function. Based on the specification of the rules in accordance with the Participation Contract, the author raised suggestions to relevant preparatory work in the process of preparing, organizing, operating and managing the Shanghai World Expo 2010.
