Problems In The Legal System Construction Of China's Rural Social Security

Rural social security is an important part of the new socialist countryside and plays an important role to promote the socialist harmonious society. However, even China's rural social security system has made some achievements, but it also faces daunting challenges. For example, the first problem is the content of rural social security is narrow; the second problem is low of insured rate; the third problem is the rural social security fund operations and the last problem is some advices about Social Insurance Law (Draft). This paper is on the basis of these empirical material trying to use law and the legal elements of the basis analytical tools analyzing legal system related issues in the process of integration of urban and rural of social security.This first chapter is talking about the content of rural social security system project. Its problem is mainly about narrow of social security for rural residents in the project, it did not adequately protect the interests of rural residents. For this problem, the Government should increase social security in rural areas to build the strength of the legal system and distinguish between primary and secondary, in the present stage focused on rural residents in health insurance and pension insurance.ChapterⅡof this article is-talking about the coverage of mainly body of rural social security system.their problems is that the current rural population of the insured rate is not high. The reason, first and foremost is the old concepts "raise children to provide for old age" still alive and prevalence; followed by low income farmers, unable to bear or not bear the insurance cost of spare cash; and finally and most importantly, because of the current farmers have different from pure farmers, landless peasants and migrant workers into three categories, the current social security system of their identity conversion very good interface. To address the above problems, the Government should put the appropriate policies, such as increased social security and propaganda, to enhance funding sources for rural residents in different situations, that they should include the corresponding social security projects, so that more rural residents to participate into the rural society security system.ChapterⅢof this article is talking about the rural social security fund operations, its problems include funding sources, the narrow channels and inadequate of funds operating mechanisms. To address the above problems, the solution including the adoption of measures to further broaden the sources of funding channels, to make funds maintenance and appreciation of the work and to strengthen oversight, improve the financial operation mechanism.ChapterⅣof this article is talking about "Social Insurance Law (Draft)", through their study of the details of some are more conductive to rural residents of the proposed construction of the social security system.
