Study On Function Of Local People's Congress Supervision In China

The National People's Congress supervision is an important component of the supervision system of the party and the state, an important constitutional power of NPC. Implementation of the supervision by the NPC is the fundamental requirement to implement the Rule of Law and strengthen the democracy and legal system, which is not only a statutory right to the NPC, but also a statutory obligation of the NPC. Especially in terms of local people's congresses, supervision is the most basic, most important and most widely and frequently used authority. Whether Local people's congresses can fully act their supervision or not will directly affect the acting of people's right to monitor the state and the healthily operating of the mechanisms of national supervision, moreover, it will directly affect the development of the work of local people's congresses. By law, after years of practice, local people's congresses have formed a complete system of work methods, and effectively played a role in oversight functions. Meanwhile, local people's congresses have also made remarkable achievements in supervision, provided a strong impetus to the economic and social development, and improved living conditions and democratic legal system. However, for various reasons recently, in the process of acting supervisory functions by the NPC, there are still some problems and deficiencies, which determines the need to further improve local people's congress supervision, improve the quality of supervision work, and enhance effectiveness of supervision work.The first part of the paper describes the significance of the local people's congress supervision, provides a brief introduction to the research on the current status of supervision by the local people's congresses and its main achievements in the domestic academic fields. It also briefly described the purpose and methods we are following in this paper to research on supervisory function of the local people's congresses.The second part of this paper described relative problems of supervisory function of local people's congresses in detail, from five aspects as following: the relationship between local people's congresses and local administrative departments, the responsibilities of local people's congresses, the supervision principle of local people's congresses, the supervision work of local people's congresses, and the characteristics of supervision work of local people's congresses.In the third part, by the analysis of current supervision work carried out by local people's congresses and the example of People's Congress of Heze City, Shandong Province, we summarized the new characteristics of supervision presented by the local people's congress under the new situation, and briefly introduced the achievements in supervision by the NPC in recent years. Combined with practice, we carried out a more deeply analysis on the situation facing by the supervision work of local people's congresses, mainly focusing on changes in the mode of economic development, the enhancement of people's civil conscience of democracy and law, the defects of social management, which proposed new demands and challenges to the supervision work of local people's congresses.The fourth part, taking people's congress of Heze City, Shandong Province as an example, pointed out the problems during the acting process of supervisory functions by local people's congresses, such as lacking of overall understanding in the role and function of supervision of the NPC, lacking of diversity of forms to act the supervisory function by the NPC and the weakness in effectiveness of supervision by the NPC, and then, reasons for these problems were analyzed.In the fifth part, the author provides views and suggestions on how to further improve the supervision work of the NPC, from years of practical experience in NPC. To summarize, these suggestions are to innovate the concepts of supervision, and enhance the vitality of supervision; correctly handle the relationship, and create a favorable external environment; accurately grasp of the principles of supervision, and maintain the correct direction of supervision; highlight the focuses of supervisory work, and enhance effectiveness of supervision; improve the way to act supervision work, and improve the quality of supervision work; strengthen self-construction of NPC, and improve ability to perform their duties according to law.In the sixth part of this paper, the results of this study are briefly summarized, and the basic conclusions of this research are drawn.
