The Legal Issues Of Food Safety Research

Food has a close relation with everyone's life and health. The food safety issue is critical to the life and health of every citizen. But failure of market supervision causes food safety incidents happened frequently. The supervision of food market should be established by legal methods to certain the subjects of market supervision, system and responsibility, which are the fundamental measures to solve the problem of market regulation.This article takes the problem of the present food safety supervision system in China as the object of study through analyzing of the failure of regulations in current food market by theory of market regulation. It intends to put forward effective suggestions to improve food safety supervision system.The paper is divided into four sections. The first part is the basic theory of food safety issues and market regulation. The concept of food safety includes three progressions. Through all kinds of discussion on food safety, the definition of food safety in this article is on the narrow dimension, which means the food safety is relatively safe. The introduction of the legal theory on market supervision analyzes from the concept of economics theory of market failure, the necessity of market regulation, and enumerates market regulation, makes market supervising positioning. All these are theoretical basis of food safety supervision legal system in the market of suggestion.The second part is current situation of the supervision of food safety. From the current situation of food safety, and uncompromising contradictions market rules, the article analyzes the necessity of supervision, and further describe supervision and the historical evolution of the legislation At present situations in food security market, then, analyzing the main problems, important system and practice of dilemma in the new food safety system which is established in "Food Safety Law".An advice from others may help one's defects. The third part is the comparative study. In horizontal, the part lists the rule of law and regulation pattern of the EU, US, Japan, Britain and other developed countries and regions, makes a comprehensive comparison on the advantages and disadvantages, summarizes their the experiences and lessons, and puts forwards suggestions to the model, the coordination agencies and food safety standards of China.The fourth part is about legal advise on China's food safety market supervision and regulation The part is divided into the following five aspects:to increase supervision principle "through-train" full supervision guiding ideology, to strengthen specialized agencies on main duties, to strengthen the enforcement of the regulation, to perfect the system, and to increase the responsibility for illegal activities.
