"Company Law" Article 5 on corporate social responsibility, is a moral law of the terms of a useful attempt. Administration of justice is the typical form and a prime choice of outside force to urge the company to fulfill its social responsibility. As a matter of principle,"Company Law" Article 5,which in explosive discussion of its features, still need to carefully examine the referee. Is Corporate social responsibility just as spiritual provisions or moral terms on "Company Law"? How should we view the legally binding of corporate social responsibility in fact? Intending to sort out the academic disputes on corporate social responsibility and the analysis of judicial practice on the basis of a number of typical case, this paper tries to Preliminary study the legally binding of corporate social responsibility. Of course, this paper just clarifies some vague understanding of the legally binding of corporate social responsibility and foresees the possibility of its judicial practice, without overemphasizing the effect of justice to enforce the company to fulfill its social responsibility.
