China's Commercial Banks Regulated By The Laws Of The Challenges In The Context Of Financial Innovation And Countermeasures

Due to the new development of modern banking business with the financial innovations, Chinese banking supervision system has encountered severe challenges. All the nations of the world have to re-inspect the issue of prudential supervision after the outbreak of the 2007 worldwide financial tsunami. This paper will be based on the current specific economic situation, focuses on the background of financial innovation, analyses the defects of Chinese legal system of supervision on commercial banks, and brings forward the countermeasures of solutions accordingly.Considering the relationship between financial supervision and financial development, the chapter one of the paper discusses the characteristics of Chinese commercial banks under the background of financial innovations firstly. Then this paper elaborates the new challenges brought by financial innovations to Chinese commercial banks' legal supervision.The second chapter of the paper analyses the characteristics of the U.S. banking supervision system and the demand on banking system reform after the financial tsunami, and picks up the useful experiences for Chinese banking supervision system.Finally, based on the analysis on the value orientation of Chinese banking supervision system, the third chapter puts forward the measures on improvement of Chinese legal system of banking supervision from three aspects of the supervision institutions, the legal system of bank, the cooperation of international banking supervision and the interaction of different legal systems respectively.
