A Study On The System Of Property Declarations In China

Since the reform and opening up, corruption has been spreading,the Communist partyof China also has been carrying on the unremitting struggle against corruption and graduallyrealize that we need closely rely on system. The third plenary session of the eighteen CentralCommunity of the Communist party of China promoted to establish and perfect thesystem of anti-corruption laws and regulations. Known as “terminal weapon againstcorruption”,the declaration of officials’ property has been a trend and played an importantrole in anti-corruption in different countries throughout the world. It’s an effective way ofpromoting anti-corruption to establish and perfect the system of property declaration.In fact, our country has began to explore the road of system of property declaration inthe 80 s and harvested a lot of useful experience through the recent experiments. It must beadmitted that the current system of property declaration in our country has a lot ofshortcomings in, let alone play proper role of the terminal anti-corruption tool. Thedeclaration subject, declaration, check mechanism are obvious deficiencies and the core linkof publication is difficult to implement, it is because that there are many kinds of constraintsin reality, these problems can not be avoided to perfect the system of property declaration inour country.This article mainly applys the method of literature research, comparative research andempirical research. On the one hand, in order to comprehensively and accurately grasp theknowledge of the system of property declaration as much as possible, the researcher refer to alarge amount of literature closely related the research topic. Through comparative studymethod in researching on the practice of Singapore, the United States and South Koreaproperty declaration and empirical research on aletai of xinjiang, cixi of zhejiang andliuyang of hunan,we can have a deeper understanding of the system of propertydeclaration and its’ present situation in China.The highlight of this article are mainly as follows: on the one hand,the researcherestablish the legitimacy of the system of property declaration through the theory ofstrengthening supervision and controlling power by system and the theory of the legal selfloss of civil servants ’ personality,on the other hand, on the basis of summarizing theexperience of ourselves and drawing lessons from other countries’ experience, theresearcher creatively put forward a conclusion that both the central and local governmentsshould play a positive role in establishing and perfecting the system of property declaration inour country with the mode of incremental steps, in this way we can promote the constructionof clean politics and minimize the risk of political society.
