Research On Juvenile Community Correction System

The thesis, taking generalized juvenile community correction as the research object, analyzes the controversial concept of "juvenile community correction", and clears its meaning. Juvenile community correction system plays an important role in preventing and rectifying minors illegal crime. At present, there are many deficiencies in juvenile community correction system of our country. Firstly, most of correction ways which are deprived of personal freedom, put emphasis on punishment. This way of correction is lack of the protection of minors’ rights in the execution, and its corrective effect is questionable. Secondly, community correction system is in confusion because of unclearance of the concept of juvenile community correction. Thirdly, the infringement of the rights of rectifiers is caused by the unclearance of correction’s subject and scope of correction’s object. Finally, the correction content is relatively single and lack of pertinence.Based on the character and purpose of juvenile community correction, firstly this article solves the problem of chaos of conception; secondly clarify the juvenile community correction system. So it applies foundations for later research on juvenile community correction, correction subject and correct content. In this research, we focus on analyzing the nature and purpose of juvenile community correction system. The nature emphasis on welfare and behavioral accountability; Its purpose is not only comprehensive prevention, including prevention first and recidivism, but also approaching and consummating about juvenile community correction, correction subject and correct content. The object of juvenile community correction expand to bad behavior juvenile and illegal juvenile; The ambit correction subject include Labour delinquents, work-and-study schools and holding school; The applicable content can be divided into the applicable content before correcting, during the correcting and after correction for content respectively. This article can be divided into three parts, the first part mainly discusses the origin, development and theoretical basis of community correction system for juvenile. Juvenile community correction system originated in America’s charity welfare agencies which experiences three development stages. It defines the concept and connotation of juvenile community correction, and applies mattings for the comparison with juvenile community correction of our country. The second part mainly introduces the legal system and problem of juvenile community correction about our country. In addition to the above problems, it also includes legislation system confusion. The third part, mainly analyses how to improve the community system. It can be divided into the improvement of the legislation system, correction subject, the applicable objects of community correction and community correction contents four parts.
