The right to education is a basic right of citizens, is the citizen can realize rights necessary to self perfection. Protection of the right to receive education of citizens is a basic obligation of governments, the basic way is to provide every citizen enough education need the material foundation and educational resources. Education resource allocation policy as the government’s basic way to achieve the above obligations, are widely used in the world. Education resource allocation policy should uphold the legitimate concept is a common consensus for policy formulation and implementation. But the denotation and connotation of the legitimacy of the very rich in this area, using what kind of conception of justice as a policy consideration of the legitimacy of the scale is not consistent with the views of the parties.The legitimacy of educational resource allocation policy should be adopted Rawls proposed the concept of justice as fairness, two principles of its content and form as well as the proposed programme direction are limited in the "a theory of justice" which refines the justice system, especially for the least beneficiaries shall obey profit on the difference principle argument. The reason is the justice as fairness can and better analysis of educational resource allocation policy legitimacy. And is superior to other analysis tools do not have. Education resource allocation policy in contemporary China by gradually to consider the interests of the beneficiaries at least. Related policy has been toward the least beneficiaries tilt. Although the distribution of educational resources in the new policy objective has been gradually meet the requirements of justice as fairness, justice, but the main policy related did not actively from the subjective to investigate the legitimacy of the distribution policy. Consciously consider limiting the two principles of justice policy, avoid the unfair education situation in resource allocation policy is the legitimacy of the objectives of the study.
