Research On Legal Control Of Food Safety Risk Information Disclosure

With the development of science and technology, the development of social economy, we are enjoying the era brought great material, our spiritual civilization, at the same time, also suffered frequent occurrence of food safety risk. The risk of food safety information disclosure system to meet the needs of the times, has become one of the important means of government supervision on food safety. Since the introduction of the system later, cognitive system is not mature, the related concepts and qualitative analysis is not clear, strict standard and the lack of laws and regulations, there are many negative effects in practice. Being revised in the "food safety law" on food safety risk information disclosure in detail the problems existing in the operation of authority and responsibilities very seriously, and other aspects of strict information disclosure from the release of main body to regulate food safety risk information, in order to achieve the effective government supervision of food safety problems.The risk of food safety information disclosure has become an indispensable part of system of food safety regulation in China, compared with developed countries, the risk of food safety information disclosure in our country is still in the initial stage of construction, standardized system has not formed a comprehensive, system, logic. In this paper, based on the food safety risk information disclosure of the specific application in the field of food safety supervision in our country as the starting point, build and improve the food safety risk information disclosure basic legal framework, attempts to explore a path of open system can effectively solve the existing defects, and from the angle of the law of China’s food safety risk information disclosure regulation put forward some suggestions. The full text is divided into four parts:The first part defines the concept and function of the food safety risk information disclosure, secondly introduces the different theories about the legal nature of the food safety risk information disclosure, and finally describes the information deficit problems in food safety supervision, analyzes the advantages and disadvantages of information tools.The second part first describes the typical cases of food safety risk information disclosure of our country, analyzes the risk of food safety information disclosure system in the presence of specific operational problems from a specific event. Then, from the "food safety law" and its implementing regulations, "the relevant provisions of the food safety information disclosure management approach" of the relevant provisions and the "food safety law (amendment draft)" three aspects to discuss the evolution of the legal basis and the standard of food safety risk information disclosure.The third part is based on the need of food safety supervision work, puts forward the necessity of the construction of the food safety risk information disclosure system. And according to the specific operation of the food safety risk information disclosure system, try to construct the architecture of information disclosure model, proposes the key content of the food safety risk in the framework of open system.The fourth part of the control mechanism of food safety risk information disclosure of the specific construction and put forward the corresponding suggestion. Firstly, this paper expounds the necessity of establishing the food safety risk information disclosure control mechanism, secondly from the legislative, judicial and administrative control of self-control of these three aspects of suggestions to establish a food safety risk information disclosure control mechanism.
