Research On The Standardization Construction Of Public Security Organs

The function of modern government is to provide public goods and services for society and service-oriented government is based on the premise of establishing a legal government. Public security organ often reflects its function of service by executing administrative power to the regulatory function of community. Public security administrative enforcement is wild-ranging and complex, involving every aspect of relative person’s life. The efficiency of enforcement is directly influenced by the accuracy and the justice of the regulating method, and it may lose its value because the method is not carried out properly. The content of public security administrative enforcement should be clear and specific and should be restricted to clear principles, so that public security organ and its staff——police can implement it accordingly. The construction of service-oriented government and legal government necessarily requires the standardization of public security law enforcement.The construction of public security law enforcement standardization is a system engineering which will achieve standardizing and efficient public security law enforcement activities, standardize and regulate the subject of law enforcement, procedure of law enforcement and system of law enforcement as well as other elements in the public security law enforcement. In order to improve its law enforcement capacity, Chinese public security organ has emphasized and carried out the legal work, meanwhile, it has also paid much attention to the standardization of law-enforcement procedure since China started the reform and opening-up policy. With the revolution of society and the strengthening of people’s consciousness of civil rights, in order to adapt to the development of times and response to the call for legal society, public security organ has put the construction of system of standardized law enforcement on the agenda since 2008, and a 6-year practice has been seen.After analyzing the status quo of construction of standardized law enforcement of Chinese public security organ in recent years, based on Shugang sub-bureau of Yangzhou Municipal Public Security Bureau, this thesis has made a conclusion that although the construction of standardized law enforcement has some achievements, there are still many problems. The construction of the subject of law enforcement is disconnected with the current situation, and the training is lack of actual effect. There still exist loopholes and regulatory gaps in the system of law enforcement, and the public security organs at different levels are lack of coordination in the process of formulating detailed rules. Compared with the act and consequences of law enforcement, the supervision and administration of law enforcement have fallen behind which can’t supervise the law enforcement from the source. Law enforcement informative system is overlapping and inefficient which are deficient in integration. The construction of working place for law enforcement is lack of overall layout, and the buildings need more repair and maintenance. The theory of the construction of open law enforcement lags behind, which cannot fulfill the goal of’people-oriented’. The selection mechanism for law-enforcement demonstration unit is unfair. Consequently these units don’t play an exemplary role for other counterparts. There’re several factors that cause these problems:there’s a large number of staff in the public security organs, which is quite difficult and complex to carry out education and training for all the police; it’s hard for the construction of standardized law enforcement to adapt to the change of rhythm during the social transition period; some police are procrastinating facing against the reform and some vested interests groups are resistant in the change.Therefore, we should take various measures, such as deepening the education for rule-of-law concept, integrating existing system of law enforcement, formulating assessment mechanism for the quality of law enforcement scientifically, rationalizing the review process for legal cases, carrying out the inspection for specialized law enforcement, consummating the confidential system for legal cases, upgrading law enforcement informative platform, and setting grading system for the construction of the working place of law enforcement. All of these measures can promote the transformation of the theory of open law enforcement, strengthen the capacity of the subject of law enforcement and regulate the behavior of the police. Under such circumstances, the measures above can protect the legitimate interests of related people and guarantee the right to know and supervision power of all citizens to the greatest extent so that they can promote the construction of legal government, which in return serves the community.
