Research On Legal Protection Of Regional Circular Economy Development

With the development of the circular economy in our country and the response of the government, enterprises and society at all levels, the practice measures of the circular economy have become concrete at the regional level. The regional circular economy gradually becomes a new kind of micro economic model with the sustainable development. The China’s regional circular economy has achieved a certain effect. However, the thin legal protection results in the slow development of the regional circular economy. The strict and clear legal system can enhance the law enforcement and judicial level of the social main body, can shape the law authority, and can benefit the building of a resource-conserving and environment-friendly society. Therefore, it is necessary to study the regional circular economy from the aspects of law and system. The regional circular economy is summarized, and the extension of the concept and the development value & principle of our regional circular economy is analyzed based on the concept and the theoretical basis of the recycling economy. Then, we analyze the legal system theory for the regional circular economy based on the jurisprudence, economics and law value, and conclude that the theory request for the regional circular economy and the legal jurisprudence is highly consistent, and that the legislation purpose and the legal value of the regional circular economy is unified. We study the present situation and problems of China’s regional circular economy legal system through the comparative analysis of domestic and foreign regional circular economy practice and legislation, and find that the China’s regional circular economic legislation is not perfect and the legal system has not been established, and that the corresponding laws & regulations and implementation rules have been seriously lagged. Therefore, in order to promote the regional circular economy development, we should take the legal safeguard measures for the legal system. Firstly, we should reflect the idea of the regional circular economy legal system in the aspect of the constitution, the basic law and the special law. Secondly, we should establish a green procurement system and public participation system to ensure that regional economy has a sound legal protection system.
