Lenin 's Thought Of Rule Of Law And Its Revelation

The construction of socialism with Chinese characteristics has entered the transition period,in which our country insisted on the implementation of the strategy of governing the country according to law.The idea of rule by law is presented at the meeting of the 15 th National Congress of the Party and on the fourth plenary session of the 18 th Party Congress is discussed in thematic form.We always adhere to the guiding principle of Marx thought in the process of our country to implement the rule of law and the construction of the socialist legal system.Today Lenin’s thought of the rule of law as an important part of Marx’s legal thought still has important guiding significance in the construction of the socialist legal system.This paper mainly discussed Lenin’s thought of the rule of law,in order to find the more specific theoretical basis for the construction of the socialist legal system.This thesis is divided into four parts:The first part is mainly to carry out an overview about formation background,theory origin and development course of Lenin’s thought of the rule of law.The formation background including the domestic environment and the international historical background;Theoretical sources are divided into two types:internal and external causes.The second part mainly makes a detailed explanation on Lenin’s legal thought from two aspects of theory and practice.The specific expression is about the sense of worth,the concept of authority,democracy and human rights of Lenin’s legal thought,as well as the practice in the construction of the ruling party,the socialist legal system and other areas.The third part is mainly about dialectical evaluation of Lenin’s thought of the rule of law,pointing out that the sources of Lenin’s thought of the rule of law are from the Soviet Russia socialist revolution and construction and it is practical and scientific.At the same time,Lenin restricted by objective historical conditions,the formation of the rule of law is not universal in guiding,it is the limitation of his thought.The last part of the thesis is about the inspiration of Lenin’s rule of law to the rule of law in our country.This part mainly expresses the influence of Lenin’s legal thought on the rule of law in our country,including four aspects:the construction of the ruling party,construction of legal system,the supervision of power,the protection of human rights.
