The relationship between a school and its students is an equal and free exchange one according to the theory of education industry, as well as that of the education market. At the end of 1990' s, education was officially designated to the brovince of the third industry, which forms the idea that education is a kind of service. Under the condition of modern market economy, contracts is the ideal way to realize the market exchange relationship between education service and educationconsumption, increasing number of education contracts appear in the practice of uncompulsory education service. But most of these contracts are not conform and consequently, they are not playing full use. Hence the establishment of education system is urgently required. Education contract is one that requires the education bodies offer intended uncompulsary education for the educationees on the foundation that educationees pay for the spedific education to the education bodies. Thus , education contracts will be seperated from the civil contracts of education administrative management and as a result, they will reflect the relationship between education bodies and educationees. Education contracta have the common characteristics of all the civil contracts, with its distinctive traits in objects, subjects, content, establishment and validity, enforcement, obligation, interference,, of the government, the planning of the nation, etc. In general, the illegistration of education contract should take scientific way of thinking , obey a special principle and adopt its unique and suitable pattern.
