China's Financial Regulatory Law Model Study

In a perspective of law, this thesis attempts to study the fundamental principles and mechanisms of the standardiztion of financial supervision mode , and to discuss how to establish a legal system of financial supervision mode in China. With the entrance into WTO, both law circles and economic circles face the topic which is how to supervise all-round development financial institutions . This thesis depending on the science of law and finance ,in the light of modern financial supervision law mode' theory and practice of Western developed countries ,adopting the combination of theory and practice ,hoping to establish the theory of financial supervision law mode under all-round development ,in order to better guide Chinese practice of financial supervision mode .This is the aim of this thesis .and then ,the author will explain the significance of this thesis. First , the economic and law phenomenon existing of financial supervision mode is because of every country's special economic , political and cultural conditions .Hiding in the phenomenon are some basic law spirit , which is what we often talk about . The author holds the basic principles are safety and efficiency .Through the study of this thesis ,the author attempts to establish some theory for Chinese financial supervision mode . Second , the theory study of all - round development financial supervision law mode not only think of the theory itself ,its final purpose is to guide the practice of Chinese financial supervision law mode . Thus the theory study of all - round development may completely embody its value . According to the purpose of the thesis , this thesis mainly study the basic theory of financial supervision law mode , and put out the practical solution with the basis of Chinese current situation. Besides the intruduction ,The structure of the thesis includes four chapters . In the first chapter ,the author explains the necessity of financial supervision law mode ,the analyzes it through three aspects . Firstly, the necessity of financial supervision .Secondly,Chinese financial supervision law mode ,the thesis explains it from the history of Chinese supervision law mode ,from integrete supervision to separate supervision ,and analyzes their background .Thirdly,Chinese financial supervision law mode necessity .Oweing to the the coming of foreign financial institution and the taking place of all -round development in Chinese financial market .So it is essential to study the financial supervision law mode in China . In second chapter , the thesis focus on the basis theory offinancial supervision law mode . The author explain it through three aspects . Firstly,financial supervision mode ,mainly talk about the definition ,kinds and every kind' advantage and disadvantage .Secondly, the aims of financial supervision law mode ,which are to keep the safety and stable of financial market ,to protect the investor and the public' benefit ,and to enhance the international competition of the whole financial industry . In the third chapter ,the comparision of the financial supervision law mode in England and American .The author deeply analyzes their political ,economical and cultural conditions which bring out their own financial supervision law mode . In the fourth chapter ,to better Chinese financial supervision law mode .The author firstly introduces the present situation ,then analyzes the existing problem ,finally achieves a conclusion which is how to establish the law system of financial supervision mode .The would be law system is to adopt the combination of integrate supervision and separate supervision' middle pattern supervision mode ,gradually realizing the combination of government supervision and self supervision ,and to supervise the supervise the supervisor.
