The legal education of university has long been criticized for big gap between the legal education and the practice. The practitioner of legal occupation moaned the graduate can' t fit in with what the position request for the shortage of professional technique training. The main reason is that the traditional teaching pattern whose singular teaching method can' t meet the need of the society. The reform of the traditional teaching pattern is necessary , we should take the reality of China into account, learn experience in practical teaching method from abroad,especially from the UK and the U.S.A. , and explore new teaching method for formation of new teaching pattern .In practice ,many legal faculty are participating in reforming about teaching method , adopted such practical teaching methods as the case teaching, clinical legal education and the case analysis . Looking upon the task and question as its core, the moot court teaching method stresses that students themselves taking part in teaching activity and becoming the body of the teaching activity, generating the knowledge, finding the knowledge , switching the knowledge , enlarging the knowledge. The moot court teaching method , as an ideal teaching method, has been adopted by many countries, adapt to Chinese circumstances and have great value .In the first part of the dissertation, it not only analyzes the gist of selection of legal methods, from the aim of legal education , the direction of modern education reform , the legal subject' s nature and its knowledge form , and the time as well as substance condition , but also states that moot court fit well in with the modern gist of selection of legal methods. In the second part, via comparing other practical teaching method with moot court, we conclude that the case teaching method isn' t fit with our national condition; the clinical legal education encounters the difficulties in its promoting; the intensive practice of legal professionals can' t achieve their aim , then we conclude that moot court is a more ideal practical teaching method . The third part discusses the design of moot court and deals with its concept, history, its flaws in the application , the teaching process of moot court, and its assess, security and improvement.
