Study Of Engineering Construction Tendering Law System

The law of the People's Republic of China on Bid invention and Bidding was adopted at the Standing Committee of the eleventh National People's Congress on August 30,1999 and effected as of Junile 1, 2000. The law has got fine effects in the area of the construction engineering. However, there is still key some problems regulated so principal that the law can't be executed well. Besides, the statutory provision on the basic system are also not well arranged. The paper intends to analyze the defaults of the law on the stand of the economic law and propose some measures to deal with the existing problems.The article is distributed into six parts.In the first part the paper discusses the concept and legal characteristics and also the development of the bidding and tendering for the construction in china.The second part discusses the object of the bidding and rendering which is divided composed of economic object and public policy object. The part also make an analysis of the principle of the bidding and tendering for construction project, including openness, fairness, impartiality and good faith.The third part discusses the specific scope and threshold for bidding of the construction project.In the fourth part, author make a complete analysis on the practice of methods of the bidding, and point out the decencies of the legislated methods, and some measures are proposed to deal with existing problems.The fifth part emphasizes on the examination of the qualification and the opening, evaluation of the bid and also the supervision and administration of the bidding and the tendering.The last part of the paper discusses the remedy procedure of the construction project tendering. The objection in construction project tendering is very useful on exercising supervision over purchaser's behaviors and decisions and the procedure they obey. The author of the paper intends to make an overall discussion on the construction project tendering objection and its'examining procedure in a macro-sight. In this part, the article points out the problems during the performance of the construction contract and why they occur and what we should do. It is pointed out that strengthening the management of the construction contract is beneficial to keeping construction market in order. Besides, the part also discusses the crime relevant to the construction project bidding during the issuing of tenders and the contracting for a project.
