Study Of The Legal Issues Of Finance Lease

It has been about 20 years since financial leasing was introduced in China, but the weak legislation and relatively poor research has impeded its fast development to some extent. This thesis explores some legal issues about financial leasing with references to home-and-abroad financial leasing legislation. This thesis has 40,000 characters that are divided into three parts.Part I: Financial leasing conspectus. This part set forth the different concepts about financial leasing in the different countries and its four genres. The history of financial leasing is analyzed and most of the standpoints on its legal character are evaluated in the end.Part II: Financial leasing contracts. This part analyzes many doctrines about the legal characteristics and the operation conditions of financial leasing contracts. Then the special rights and obligations in the financial leasing contracts are discoursed upon.Part III: The actuality and legislation visualizing on financial leasing in China. This part describes the actuality and problems of financial leasing in China and brings forward some countermeasures. The author consults the references to home-and-abroad financial leasing legislation and conceives the financial leasing law in the future in China.
