On The Honest Government

The government of good faith must be faithful to the law, to the people and to other countries, and the administrative agencies of the government must be faithful to each other too. Administrative activities of good faith means that administrative organs must perform the tasks assigned to them according to the law, basing on the due consideration of the state of affairs, with the aim to serve the people. Administrative activities of good faith consists of such four main points: Firstly, the main aim of the administrative activities is to serve the people; Secondly, the administrative agencies must act according to the law, Third , the administrative agencies must act according to the conventions of the administrative activities unless it is necessary not to follow it; Finally, administrative agencies shall not act unreasonably.The principle of good faith in administrative law is the foundation of administrative activities of good faith. So the paper has a detailed account of the principle of good faith in administrative law.By analyzing the degree of good faith of Chinese government, the harm of administrative decisions which aren't made in good faith and the reasons why the government doesn't act in good faith, the author points out that we must construct a government of good faith from such six aspects: First, we must accelerate the reform of administration to changing the functions of government; Second, we must build a scientific and democratic mechanism of making administrative decisions; Third, the administrative activities must be known to people, and we should construct a mechanism of freedom of information to build a government in the sunshine; Fourth, we must build a mechanism to evaluate the credit of the government; Fifth, we mus.t make sure that the mechanism of remedies runs wellhen administrative activities do harm to the citizens; Finally, we must do something to urge the civil servants behavior morally. The supervision of the administrative activities is essential to building a government of good faith. In the third part of the paper the author points out that administrative decisions of good faith must be made under the supervision of the legislature , of supper administrative agencies, of judicial departments and of the people .
