On the one hand, international trade in services is increasingly becoming the main trend of modern economy with the rapid development of information society and integration of world economy. On the other hand, although thousands of articles and monographs have been written and published on rules of origin in circles of economics and science of law, most of them cover only the rules of origin on goods and rarely touch the rules of origin on services. This article, realizing the significance of rules of origin on international trade in services and scarcity of reseaches in China at present, referring to the Agreement On Rules Of Origin and practices in certain countries and regions, analyzing the characteristics of trade in services, puts forward a blueprint of rules of origin on international trade in services.This article, as long as about forty thousand words, consists of four parts.Part I is an introduction of trade in services. After introducing several typical definitions of trade on services, this part summarizes the features of trade on services, which differentiate them from those of trade on goods, and classifies trade on services.Part II is a bird'-eye-view of rules of origins on goods and an in-depth analysis of the necessity and feasibility of rules of origin on services. The first part covers the definition and classifications of rules of origin, the roles rules of origin play in international trade. Rules of origin shall be defined as those laws, regulations, administrative determinations of general application applied by any Member to determine the country of origin of goods. Rules of origin may be classified from four different angles and have a positive role and a negative one as well. The second part analyzes the necessity and feasibility of rules of origin on services.Part III covers the special significance rules of origin on services can provide for China. Besides some general reasons dealt with before, China shall play a leading role in the workout of rules of origin on services in consideration of " policy-makers are always beneficiaries of their own policies" and solving forthcoming trade frictions. CEPA is, undoubtedly, an encouraging and exploring step in doing that.Part IV is the blueprint of rules of origin on services, which deals with the principles of rules of origin on services, the definition and application of rules of origin on services, the classification of rules of origin on services and specific rules of origin on services. Principle of MFN treatment, principle of national treatment and principle of transparency are dealt with first. Rules of origin on services shall be defined as those laws, regulations, administrative determinations of general application applied by any Member to determine the country of origin of services. Rules of origin on services can be divided into four types. As to the specific rules of origin on services, this article offers its explorations according to the definition of services in GATS.
