Discussion On The Administrative System Of Incentives

This article summarizes the basic paradigm of administrative jurisprudence form the influence deeply rooted in the sense of state administrative jurisprudence that derives from the development of modern public administration. The impact leads to the abnormal problems in the area of administrative jurisprudence, which then results, into the crisis of administrative jurisprudence paradigm. It is under the age of administrative jurisprudence's paradigm shift that this article analyzes and describes some series problem of theory and practice in administrative encouragement, on the basis of which a review is proposed about the relevant problems existing in the administrative practice in our country. Several suggestions are further given of perfecting our administrative encouragement system, in order to make it strong enough to bear, with other administrative goal, and facilitating economic growth and social progress.Chapter 1 of this article is analyzing the definition of administrative encouragement. This chapter begins with a review and reconsideration of the problems existing in current concepts and comes to a revised definition of the scope of administrative encouragement, in order to make it more matching to social reality in terms of connotation and extension, which will benefit our analysis and research of the problems.Chapter 2 of this article is analyzing the internal mechanism of administrative encouragement. This chapter argues for the justness of administrative encouragement, analyzing and verifying several main factors supporting the existence of administrative encouragement, namely the shift of administrative jurisprudence's paradigm, the variety of the administrative mode ,forming of the service administration, theapplication of "economic people supposition" in administrative jurisprudence. This chapter also takes tax incentives and scientific encouragement as the chief source through an actual investigation of the application practice of administrative encouragement.Chapter 3 of this article carries an institutional research of administrative encouragement. It concludes and analyzes the systematic limitations of current administrative encouragement ,and undertakes an institutional research of administrative encouragement mainly from basic principle and relief, in accordance with the principle of administration by law.
