It is awareness that the modern Chinese civil procedure law is germinated in the later half of 19th century, emerged in the Qing Dynasty , but not everyone can wake up to that . Reviewing this history , it is helpful for us to clearly understand the historical origin of Chinese civil procedure law and deepen the apprehension of Chinese civil procedure legal tradition .Comparing with Japanese experiences of modernization in order to draw a conclusion between the imported law and the national law . At the time of amendment of current Chinese civil procedural law , it is necessary that we make an observation on the beginning of modernization in the late Qing Dynasty and make a forecast on the trend and the future civil procedural law .The paper is made up of three chapters:Chapter one summarizes the reformation of civil procedural law in the end of Qing Dynasty .Chapter two introduces the Japanese background cause process and signification .Chapter three comparing Chinese and Japanese , elicits the sameness and differences from the reformation of the civil procedural law .These differences enlighten our experience in the future , not only the pattern but also the spirit in the new civil procedural law .
