Private enterprises of China,with continuously and steadily developing in recentyears, are playing more and more important role on our economy and society.However, while our economy and society being promoted, the relations betweenlabor and capital in private enterprises are distinct imbalance which is magnified inthe period of the social transition and embodies the contradiction and conflictbetween labor and management in private enterprises. Nowadays, the contradictionbetween labor and management in private enterprises is that the employers controllabor market to much extent and that the employees in private enterprises are treatedunfairly and that the trouble between labor and management is obvious. In modernsociety the relations between labor and capital is the axis of the social system.Therefore, solving the problem that the workers are treated unfairly is beneficial totackling the relations between labor and capital in private enterprises of China and thefair treatment of the whole worker class, having better knowledge of harmonioussociety and rationalizing relations of different interests so that the society can runsmoothly. In the essay the writer places the problem of unfairly treatment of the employeesin private enterprises under the ground of social transition and analyses emphaticallythe reasons why the employees treated unfairly throughout depending on the theoryof social justice and a great deal of man-made data. The conclusion of the essay is: ifthe government doesn't play a role on maintaining the profit of the employees, if theemployers have less law consciousness, management idea and occupation moralityand if the status of the employees weakens more in the period of social transition ,thedisadvantages of the employees in private enterprises will continue. It's necessary forChina to emphasize the function of government, the employers and public opinion inorder to solve the problem. The government must change the state of doing nothingand less than it should do, set up fair basic value idea and play an important role onprotecting the right of the employees in private enterprises.
