With the development of globalization, the bribery committed by multinational corporations has crossed the border and the target of bribery has expanded to foreign officials. The bribery of foreign officials committed by multinational corporations has seriously impaired the political, economic interests of the home country, the hosting country and the international community. Besides, such acts shall destroy the existing business ethics. This thesis starts from the introduction of the current status and the adverse influence of the bribery of foreign officials committed by multinational corporations. Hereafter the thesis introduces and analyzes the current related laws in this respective. In the meantime, this thesis discusses the problem and disputes concerning the jurisdiction of such cases. As the most important part of this thesis, this thesis introduces and analyses the following measures: (1) Establish such bribery as a criminal offence under the law; (2) Harmonize the differences of legal definitions between different countries; (3) Abolish the tax deduction of the expenditure for the purpose of bribery of foreign official; (4) Strengthen the monitoring of the act of multinational corporations; (5) Closer cooperation in the respect of judicial assistance and extradition; (6) Hold the parent corporation of multinational corporations liable for the bribery of its oversea subsidiaries and partner; (7) Impose a stringent legal liability upon the multinational corporation which has committed bribery. In conclusion, this thesis proposes some suggestion for improving and perfecting of Chinese relevant regulation.
