China Sustainable Use Of Water Resources In The Legal System

Water resource is an important natural resource for all humanbeings.But it is at the edge of being dried up,as it has been overused for years.Realizing this ,countries all over the world are trying to find a way , while keeping water ecological balance,to ensure that water resource would be enough for humanbeings for ever. As a developing country,China carried out a policy which regarded water resource as valueless thing.This policy arose many problems such as abuse and waste,and its affection still exists today.The national water resource condition is not optimistic,with going down water quality,worse water condition,and lots of water pollution accidents.On the other hand,low water utilization efficiency and serious waste of water aggravate water resource shortage,which hinder us to develop our economy. So we have to found a series of legal system to adjust this.That's why this paper is wrote.In this paper ,the author first analyses the condition of water resource of China,and find out the cause of the shortage: unproper system arosed by wrong realization of the relations between water's ecological value,social value,and economic value .Thus the author gives a brief introduction of water management system of some developed countries such as American, New Zealand, Britain, and Japan, and with Philosophical,Economical and Ecological Theories finds the way out: legal system of sustainable utilization of water resource. The author thinks that ,from the angle of three basic value of water resource,we may devide water resource into three kinds:water for basic living ,water for ecological use and water for economical use.As for water for basic living and water for ecological use,we should leave them to the Government,so as to overcome "Negotive Externalities" and realize ecological and social value of water resource. On the other hand, leave water for ecological use to the Market ,so as to realize economic value of water resource.More than that,the author also gives some advice to improve China's legal system of sustainable utilization of water resource.The paper, except preface,consists of six parts.Part 1 The Arose of Sustainable Utilizaion of Water ResourceIn this part,the author firstly gives the definition of " Water Resource" ,and distinguish it with another definition "Water Product" .Then the author gives a introduction of the condition of water resource of the world and China,and analyses the cause: unproper system arosed by wrong realization of the relationsof water's ecological value,social value,and economic value .Based on that ,the definition of "Sustainable Utilizaion of Water Resource" is arose.Part 2 The Definition of Sustainable Utilizaion of Water ResourceIn this part,the author firstly introduces the origin of "Sustainable Utilizaion of Water Resource" : "Sustainable Development Theory" ,and then gives The definition of Sustainable Utilizaion of Water Resource.The author also gives the theoretical basis of Sustainable Utilizaion of Water Resource, with Philosophical^Economical and Ecological Theories.Part 3 Abroad Water Resource Management SystemIn this part,the author gives a brief introduction of water resource management system of some developed countries such as American, New Zealand, Britain, and Japan,and then learns some lesson from them.Part 4 The Choose of Patten of China's Legal System of Sustainable Utilization of Water Resource.In this part, the author firstly gives a introduction of two traditional pattens: Market Patten and Government Patten, and then compares the advantage of them.
