Study Of Engineering Construction Supervision System, A Number Of Legal Issues

On the basis of the analysis of the framework and practical plans in the system of construction supervision, with the application of the basic theories of law, the present laws, regulations and the theoretical research on construction supervision, important issues concerning law in Chinese construction supervision system are analyzed. And some problems in law and in practice are pointed, some suggestions in legislation are put forword to help the construction supervision develops healthily.The first part is the brief account of construction supervision, in this part, the definition of construction supervision is analyzed, and the Chinese construction supervision system is introdused, the author point out the emphasis of the article is to analyze the legal status of construction supervision, the relationships among the employer, the contractot and the construction supervisionunit, and the legal responsibility of construction supervision.The second part is the legal relationship among the subjects in construction supervision system. According to the Chinese construction laws, abasised on the relationships among the three subjects, analyzed the mandate relationship between the employer and the construction supervisionunit but not agency relationship. And analyzed the unusual or illegal relationships among the three subjects in construction fieldIn this part, the relationship and difference of construction supervision and quality supervise center are analyzed, a proper way to deal with the relationships is also studied.In particular,a new practical perspective of understanding the nature of construction supervision is proposed.The third part is the legal responsibility of construction supervision. In this part, the responsibilities and duties of the construction supervision are analyzed.furthermore, regulations on construction supervisionare suggested to set down so as to standardize the definition and scope of construction supervision, and according to some real cases, the three different responsibilities of construction supervision are analyzed, such as civil liability, administrative liability, and criminal liability.
