| China's joining WTO will exert significant influences on our country's economic legal system, especially on economic legislation and law application, In the respect of economic legislation, China has promised to amend old laws and supplement new articles in line with the international rules of WTO, which will mainly involve foreign trade and foreign investment legislation. Since the first law concerning foreign investment in China was promulgated, the law on Sino-foreign Equity Joint Venture, China has taken large steps to develop legislation relating foreign investment and to provide the legal framework for the forms and activities of foreign investment. And the foreign direct investment in China has developed rapidly in recent years. China's entry into WTO also makes more foreign investors move their operations into China. All this, adding with the promise that China made at his entry into WTO, that China will modify its related laws and regulations to answer the requirements of WTO.TRIMs (Trade-related Investment Measures) is a key part of WTO legal system. It adopts the main principles of the international trade law and creates a completely up-dated applicable legal system for international investors. While China's foreign invested enterprise law, which has played a key role in absorbing foreign investment, can no longer meet the needs of opening up and reform in market economy. This article analyses the deficiencies and their cause of formation of the current foreign invested enterprise law and puts forward how to coordinate it with TRIMs and how to re-construct and reform it.The perspective of this article is started with the basic theory of the relationship between international law and domestic law, actually it is the effect and the way of application of international law in domestic countries. It is the enforcement or the generalagreement that realizes the application of international law and what is possible and reasonable trend on this issue? Based on this theory, it is quite natural to discuss the application modifications of TRIMs into China's foreign investment related laws and regulations. |
