Legal belief is the soul and psychological basis during the process of construction of the rule of law, and it is the highest idealistic issue in a society. We have solve the difficulty of lacking of laws from the"rule by law"to"the rule of law", but we do not solve the problem that people do not have the belief of law all the time. As to the crisis of belief that people do to the law, this article will analyze the reason that the legal belief can not grow from the point of view of the growth of legal belief. The author will try to provide some constructive path about the growth of legal belief after anatomizing the actuality deeply of the rule of law of China.This article have four parts.The first part mainly demonstrate the concept of belief and legal belief. Through the theoretical hackling about the legal belief, the author point out the significance of legal belief, and it is very important to the construction of the rule of law of our country.The second part analyze the difference of legal belief between China and the western countries. This part mainly contrast the difference about the language's condition,religion,morality and the Civil Society between China and the western countries, and through summing up and reflection, the author analyze the reason that the legal belief can grow in the western countries, at the same time, the author point out that legal belief can not grow in China exist the historical reason. Only through the historical comparison of legal belief between China and the western countries, we can find that why the legal belief can not grow in China from the root, and it will help us to recognize the problem. As to the methodology, this part adopt the antitheses and analytical method, and choose the legal culture of China and the western countries to comparatively study.The third part is established in the actuality of Chinese law, through analyzing the legislation,execation of law,judicature,legal consciousness,letters and visits, the author expatiates the reason more that why the legal can not grow in China.
