With the complete advance of the housing system and finance system reform, developing the housing finance has become the key problem of starting the housing consume. As one important part of the housing finance, the personal housing mortgage loan becomes the focal points of the public opinion. However, for its long time limit and bad mobility and the personal credit system has not built yet ,the housing mortgage inevitably makes the bank face risks Although it has not exposed yet, it will cause a bad effect when it expands rapidly and accumulates to a certain degree. Therefore, as for the different risks the banks are faced with when carrying though the housing mortgage loan, it is indispensable to analyze them and find out the countermeasures which will eliminate the bad effect and thereby improve the housing mortgage loan.This dissertation emphasizes on the personal housing mortgage loan Based on the analysis of housing mortgage loan risks, it establishes a set of borrowing-and-lending models between the bank and the customers from a dynamic view, which illustrates the formative reasons and systems of the credit risks of the personal housing mortgage loan, it finds out the factors relating to the credit risks and utilizes the differential analysis to evaluate the credit risks of the housing mortgage loan . Based on the analysis it puts forward some countermeasures on how to reduce and avoid the housing mortgage loan. Using the method of comparison and analysis, combining the theory with practice and dialectic development, Analyzing the legal system on housing mortgage loan both from theory and from current situation. Also from the thought of balance and harmony of economic law, I compose a rudimentary idea on perfection of this system. After a complete analysis maybe it will have a reference value on the theoretical study and application of the risks of the housing finance.This dissertation consists of four major parts:The first part is the general statement of the legal system on housing mortgage. It states the definition, classification and features of the housing mortgage and the value signification of housing mortgage in our country.The second part introduces the mode of housing mortgage in western developed countries, especially U.S U.K and Germany.
