In pace with terrorism indulging in wanton massacre and spreading quickly in the whole world, the international zeal of anti-terrorism runs higher and higher. Especially in the aftermath of the terrorist attacks of September 11, 2001, international society has reached an all-time consistency on anti-terrorism. In the wake of the appearance of S/RES/1373 (2001), Counter-Terrorism Committee emerged as the times require, and many countries and districts such as U.S.A and U.K. have passed some related legislations in succession, adopted anti-terrorist measures, providing legal basis for striking terrorism effectively.Scanning these legal documents, their common grounds lie in: enlarging the state's power scope of investigating, prosecuting and trying terrorists, the administration's measures to anti-terrorism becoming more flexible and more effective and the action of anti-terrorism being remarkable; simultaneously, terrorist suspects and defendants' rights and freedoms being limited to some extent. Speaking impersonally, most of these legal documents are timely and effective, not only in favor of striking terrorism and preventing happening anew of another terrorist event, but also being propitious to renew and maintain national security and help citizens resume confidence to security. However, we have to realize that some provisions of these documents go beyond the ambit of International Human Rights Law on the one hand, and on the other hand some state bodies evade legal provision or misconstrue legal connotation on purpose in order to get convenience in the process of investigating, prosecuting and trying terrorists.China has suffered from the Eastern Tujue terrorism for a long time. Terrorism is not far from China. At the time of the tidal wave of terrorism sweeping the whole world, China is definitely impossible to stay aloof from the affair. But up to now, China's anti-terrorist activities rest on the lay of policy basically, not forming a suit of integrated legal mechanism, especially procedure, to punish terrorism.
