Revenge Of The Ancient Chinese System

Revenge is one kind of criminalities that need to be punished in ancient society of China. Meanwhile, it is also spoken highly by the traditional morality. Revenge phenomenon continues dynasty by dynasty in ancient China and never ceases its functions. The fundamental reason lies in the contradictions as well as conflicts between laws and moral ethics embodied by revenge actions. The methods to cope with this kind of contradictions and conflicts vary to some extent in different periods. However, the trend is that people more and more emphasize the importance of laws. Therefore, the research on revenge system is of great importance to the reinforcement of juristic consciousness nowadays.We discuss the patterns of revenge system during the birth and development phases of feudal society detailedly in the first part of the thesis. Private revenge is restricted step by step and conditionally in the perspective of laws from the Spring and Autumn and WarringStates periods of China to Tang Dynasty, but people didn' t find a very good method to settle civil revenge actions. In chapter 2, we mainly investigate the fundamental characteristics of revenge system in ancient China, which comprise of four aspects. First, revenge system exactly reflects the intractable intrinsic contradictions of feudal society of China. The intrinsic contradictions include those betreen the Confucian or feudal ethical codeand the law. The second characteristic of revenge system is that the main body of revenge includes not only the adults, but also the female and the minors. This has not only reflected striking root in the hearts of the people of revenge concept , and has also shown that the revenge is cruel and trail .The third characteristic of revenge system is that the cause of the private revenge is for close relatives usually, including parents brothers as well as spouse among the close relatives.
