In the process of the evolution from the original tribes to the politics, the ancient Greek not only deliberates their philosophy, but also creates its special myth and the kind of system of Gods to guide the people and the direction of behaviors of the politics through various kinds of oracles, which setting up own politics legal systems. It is regarded that the attitudes of myth had been changed from concentration to disgrace form the ages of enlightment that the people taking reason as the sacrament. This monograph demonstrates that the defects of ancient Greek's democracy and legal systems by analyzing myth of the commons. Therefore, the target of this article is that shows the viewpoint that the studies of the Zeitgeist are the impartable part of jurisprudence and disagreement about the tendency of pure legal positive theories.This article is divided into five parts:The first part is the preface that induces the topic of thesis through the examination on legal positivism.The second part is to explain the racial impetus of myth within a great variety of comments in histories of culture and politics in order to oppose the standpoints of traditional reasons since the ages of enlightment. Accordingly, Vico and Hamann gave us the enlighten directions.The third part emphasizes that the myth tradition to the ancient Greek that carry on the analysis, learning to clarify with many virtuous ethics. On one hand, we discuss the duty and responsibilities, right and wrong according to the free will. Furthermore, the other hand is that we may disagree the opinions of the destination by Kant's freedom.By using the Hegelian theories, the author concentrates on the fatalism for the sake of antagonism with the two spirits mentioned above.
