Study Of Product Liability Insurance System

With the development of system of Product liability, product liability insurance system emerges in developed countries .It is helpful to protect the legitimate rights of customers, and disperse the risk managements of producers and sellers, therefore it gradually expands to other countries. In western countries, it becomes more and more perfect because of their advanced insurance theory. China now has no one, which hampers Chinese economic development. With the globalization of economy, developing of international product liability and more product liability actions, the system became more and more important. So,perfecting our country's legal system of product liability insurance to protect customer's rights and disperse the risk managements of producers and sellers is an essential question in our economic construction.Besides abstract and conclusion,the thesis is totally divided into four parts. It has made comparatively systematic research on the legal theory of product liability insurance. Because in our country the theoretical research lies behind developed countries relatively, advanced theory results and practical experiences of the west are referred to in our product liability insurance. It is pointed out problems that it has in the current system, explained the necessity to strengthen it and proposed how to perfect our product liability insurance and its legal system.Part one is the outline of product liability insurance system, first gives the definition of product liability insurance ,the development of home and abroad.Belonging to property insurance,product liability insurance is of basic characters of traditional insurance. It also has some characters different from traditional property insurance. It has been a kind of public-spirited insurance at some degree.At the second part, the basic points of product liability insurance are concerned. Four principles are brought about.Then gives basic terms of product liability insurance and its interpretion principles according to the insurance law and insurance clausesAt the third part,the author believes it is necesarry and practical to perfect our product liability insurance and points out that at present some problems still exist in the field of product liability insurance in China.In part four , the advice is given to make progress in insurance law.and the author offers a review of the whole paper and strengthen the imergency and importance of building the product liability insurance.
