Theory And Practice Of Administrative Assistance

In the modem administration, because of the diversity, complexity and specialty of the administrative tasks,subject of administration always needs other's help, especially other administrative subjects without relationship of administrative subordination. The act of administrative assistance is just based on the asking of administrative assistance among them. Administrative assistance system is a great contribution to the improvement of the administrative efficiency and economic in nature, as well as a benefit to protect the legitimate rights and interests of people. At the same time, investigation about this legal system of administrative assistance will also benefit the theory on"rule of law"in China.Based on the requirement of both theory and practice, this paper contents five chapters, making an introduction to the administrative assistance system. It mainly analyses the study meaning and the function of system, according to the experiences of other countries and areas. Therefore, this article summarizes the basic theory of administrative assistance system and tries to construct a system in order to perfect China administrative law system.Chapter one is the basic theory of administrative assistance. It includes the concept,character,classification and the system function of administrative assistance, then compare the relationship between other related system and it. So the purpose of this part is to unite the notions, which served for later investigation. Chapter two is to explain the theory of administrative assistance from Jurisprudence, Administration Management and Synergetics. Chapter three is to review the administrative assistance by comparison with the different legal systems and countries ,to do some analysis on China's current situation of the administrative assistance system from legislation and practice. Chapter four analyses the each aspect of administrative assistance system. The last chapter offers some ideas and suggestions on the construction of our administrative assistance system.
