With the development of the socialist market economy and the deepening of the political reform in our country, the necessity and urgency of effective regulations as well as limitations on administrative monopoly have become prominent. Anti-administrative monopoly is one of the most significant tasks we are confronting in the process of the reforming our current economic mechanism. The anti-monopoly legislation in the developed countries featuring market economy aims at the removal of monopoly in economy. However, the fact that China is in the transition from planned economy into the market economy has determined that the content and from of anti-monopoly differs from those of other countries. Therefore, anti-administrative monopoly constitutes one of the distinctive characteristics in the Chinese society. To achieve this goal, we should, primarily define the term "administrative monopoly" , categorize the characteristics concerning the term and describe in detail its various manifestations. Only through this procedure can we cast pointed opinions in terms of the regulations and limitations on administrative monopoly from every perspective.Based on the substantial amount of materials from both theory and reality, the author, starting from the cause of administrative monopoly in China, elaborates the anti-administrative monopoly approaches from a distinct perspective, that is, from the angle of the orientation of the government role. The whole article is arranged centering the transition of the government function. It is believed that the core of bring administrative monopoly under control lies is an issue regarding reform on political mechanism. Therefore, as a research on administrative law, the article mainly studies regulations on administrative monopoly. Beginning with defining administrative monopoly, elaborating its characteristics, centering the necessity and inevitability of anti-administrative monopoly in China, the author, on the basis of analyzing the cause of administrative monopoly, aims at discussing how to fight against administrative monopoly from three perspectives, namely, the orientation of the government role, legislative regulation and limitation as well as channels of relief.
