On Terrorism, Crime Basic Investigation Countermeasures

From the end of the 20th century, the terrorism crime appears as aserious crime throughout the world. The terrorism has already become adisaster facet which threatens human's existence and safety. As theterrorism activity and terrorism crime have turned worse, how to punishand guard against terrorism crime becomes a focus in the world. In therecent years, terrorism became worse, the terrible affairs piled up oneafter another, such as the Japanese Tokyo's subway poisonous gas case,American Oklahoma's bombing case, the seriousness of terrorismactivity not only expressed on the amount, but also causing socialdiscomfort and lots of international disputes, deepening the conflictbetween nations, regions, races and religions, becoming a dangerousfactor threatening world peace, bringing turbulence and uneasiness tothe international society. The "9·11" affair taking place in 2001 in theUnited States is shading the world with terrible shadow, pushingterrorism activity to an unprecedented peak, becoming the mostdangerous crime endangering being's world.This paper researches terrorism crime from the point of criminalinvestigation countermeasure and is divided into five parts. The first partis an outline of the terrorism crime. This part compares the concept ofterrorism from the language concept, the jury concept, coupled with thecrime concept of terrorism crime, then puts forward its opinion: theterrorism crime is activities regulated by the criminal law, run by theterrorism group or people in order to cause social terror dismay,damaging national safety or public safety and social order, or organizing,implementing, preparing behaviors for carrying terrorism crime. Thispart also puts forward some characters of terrorism crime, such as thetarget aiming, the violate means, etc, from the research on terrorismcrime activities; on research on the subject, object, means, space, itpoints out some general characters of the terrorism crime.The second part is the principal of the criminal investigation to the terrorism crime. It points out that the criminal investigation to the terrorism crime shouldobey some principals, such as the legitimate principle, combiningspecialized work with crowd together principle, conjunction principle,starting before the enemy principle, quickening in time principle, limitedpublicity of the medium principle.The third part is about setting up the intelligence anti-terrorismmechanism, discussing anti-terrorism intelligence report, discussingbasic content of the anti-terrorism intelligence collection system's basicprinciples, contents, paths, etc; discussed the targets and steps, thecontents, the methods etc, of the anti-terrorism intelligence analyticmechanism.The fourth part is about the international cooperation system of the criminalinvestigation to the terrorism crime. It generalize the concept, meaning,classification of the international criminal investigation cooperation, center onsome factors of the international criminal investigation cooperation, such ascarrying out coordination investigation, the international informationcommunication, using international list as wanted measures,international cooperation in court science, etc.The filth part is about the temporary countermeasures to the terrorism crime,mainly about the cases of terror hostages, center on the characters ofterror hostage cases, such as keeping a long time, means subjected to atremendous obstacle, and high concern on the process to handle, etc; Itsconductor system should include two layers, that is, the highest decisionlayer and strategy and tactics regulating layer; hostage safety should beplaced as the most important factor to be considered; placing emphasison negotiation work, putting attention to strategy and skills innegotiation; needing wide information processing source, completecollecting intelligence in time, complete information exportation.
