Npc Deputies Quality Issues Discussed

People's Representative Congress System is the basic system of China. Constitution of the People's Republic of China defines that "All power in the People's Republic of China belongs to the people". However the people are not supposed to exercise state power directly but to elect representatives to do so instead of them. Therefore the quality of deputies to the People's Congress direct decides whether they can play the roles of representatives, which will influence not only the effective operation of State Power organs but also the authorities of both the People's Representative Congress and its standing committees. At present, whether the quality of the Representatives is higher or not is an important symbol and basis to evaluate socialist democratic progress and achievement in governing the country by law.The quality of the Representatives is a general concept, which includes the right view of Representatives, basic culture literacy, professional knowledge on laws, abilities to participate in, deliberate on, supervise politics, and receive information of politics. They also should have the abilities of logic judgment, discrimination, expression and communication. They should be of better morality and character with better physical conditions.However, the establishment of People's Representative Congress System dose not means the quality of its Representatives has met its need. As the functions of People's Congress and people's democratic consciousness have been promoted day by day, the unqualified qualities of Representatives have been a serious issue that restricts normal functions of People's Representative Congress. This kind of circumstance should be studied and solved urgently. Today, there are following inborn deficiencies during the election process of the Representatives, such as the election standard is not strict enough, the election procedure is not open or transparent enough to public, and there is usually lack of competitive mechanism. Furthermore, there are less learning and training activities within a Representative's tour of duty, which don't have much effect on them. The imperfection of the auxiliary organs leads to failure of different levels in Representatives' later training. Besides, there is short of efficient supervision and assurance mechanisms to improve qualities of Representatives, which gives Representatives wrong concepts. Therefore the following phenomenon are inevitable to occur that the Representative's identity equals to a kind of honor, and he possesses an empty position, becomes indifferent to the duty consciousness, abuse his authority and becomes easy to have behaviors of no-act or omission. Their low levels of knowledge and capability limit the efficiency and functions when they perform their duties, even some of them are compared as deaf or showing-hand Representatives, which will cause a great loss to the resources of democratic politics.Aiming at the problems and sticking points above, this paper mainly discusses the revolutionary thoughts of how to enable Representatives to have high standard qualities from three aspects of Representatives' election system, activity system and supervision system. By analyzing and learning from relative laws and rules of Western council member candidates for reference, this paper suggests to raise requirements that a qualified Representative Candidate should meet, change Representatives' proportion regulations, introduce the competitive mechanism, adhere to competitive election, advocate to set up their duty concept, construct and improve their activity system, apply full-time Representatives step by step, strengthen effective communications between Representatives and constituency, advocate report-on-work activities, establish constituency's accountability system and Representatives' assessment mechanism, exercise dismissal and resignation system cautiously, solve problems of material assurance shortage, ensure them to try their best in functions.At present in China, it is at the very time of five-year election at expiration of office terms of the NPC. This paper, from the aspect of representatives' qualities, is supposed to analyze and discuss imperfections of People's Representative Congress System and how to improve them for purpose of providing constructive suggestions for the undertakings of NPC.
