Study On The Regulations Of Chinese Movie Industry

Nowadays,there still exists many problems in legislation for China’s film industry.On the legal level, a true industry basic law is absent. "Movie Management Regulations" which is the administrative regulation promulgated by the State Council that actually fulfills the functions of the basic law. Meanwhile, the policy area fills with a large number of normative documents, such as "Film production, Distribution, Access to Screening Operation Qualification Interim Provisions", "Screenplay Project, Movie Film Review Interim Provisions",etc. The legislative level is low and the normative documents are complex,thus leading to the law construction of the film industry is far behind the practice development. In the United States, South Korea and Taiwan(China),the law is quite feasible to improve. The movie market is developing fast and healthy due to the interaction between the industry policy and law. Also it is a great guiding significance on China’s legislative work. The good news is that China has started to draw up "Movie Industry Promotion Law" and by now the draft has completed. The relevant content has become cultural, especially the film industry hot topic. At the legal aspect, there are still many issues in the draft that need to study. This article starts from the basic theory of the film industry, analyzes the problems in the developing condition and institution-building, proposes legislation countermeasures and suggestions to improve China ’ s film industry. The article is divided into five parts, the overall relationship is progressive layers.The first part. Introduction. Briefly discusses the background, significance,innovation and lacks of the article.The second part. Film industry and development process. Basic theoretical issues of the film industry are discussed from the concept and meaning of the film industry.Reveal the necessity of legal regulation for the film industry depending on the theoretical basis and practical basis.The third part. Introduce the part of the film legal regulation in the area United States,South Kerea and Taiwan that worth learning,and then some experiences are summed up.The forth part. First, systematically discusses the legislative system of the film industry; Then the main three regulations—1. censorship rules, 2. access provisions, 3.import and export regulations and the "Movie Industry Promotion Law" are simplydiscussed. At last, some disadvantages are pointed out.The fifth part. Provide advices. The content is mainly about that not enough emphasis on construction law, low level legislation, and imperfect legal system. Also,the advices on the too strict censorship, excessive executive authority to intervene are putting forward. At the meantime, the modification suggestions for "Movie Industry Promotion Law"(draft) are putting forward,too.The six part. Conclusion. The " Movie Industry Promotion Law" should be completed and published as soon as possible.
