On The Protection Of The Rights Of Landless Peasants In Urban And Rural Areas

The ultimate method to solve the obsessive Sannong problem (the problems of peasants, agriculture, rural areas) lays in the urban and rural united development, which is worthy of recognition. But as the urban and rural united development marching forward, the urbanization speeding up, the increasing requisition of rural soil has deprived abundant peasants of the soil, their mean for subsistence. Therefore, a new social group has been emerging, the off-land peasants, who are deprived of the soil which is mean of production and subsistence guarantee. What the present peasants are confronted is no guarantee of concerning rights and a series of subsistence problems, including subsistence, employment and other social problems. Accordingly, it has been considered to be the pending problems that how to appropriately tackle the off-land issue and protect the legal rights of off-land peasants.The introduction mainly presents the selection bases, putting forward the research objects, briefly concluding the concerning literature, expounding the research approaches, the sense and innovation in this research.Through the explanations of concept of the urban and rural united development and the descriptions of its recent progresses, the first part reveals the root and the present condition of off-land problems, and reflects its deep level questions.The second part introduces the placement of off-land peasants and experiences of the urban and rural united development of other countries. Combined with the present conditions of the urban and rural united development of the first part, we conclude the enlightenment of the overseas experiences. Part two points out that in order to protect the rights of off-land peasants, our government should first solve the problems of the construction of countryside urbanization, the reemployment of off-land peasants, the construction of social security system of them and the legal protections of off-land peasants and so on.The third part proposes the solutions of off-land peasants in following chapters.Firstly, I introduce the guarantee of the role transformation of the off-land peasant through speeding up the countryside urbanization construction. This way will help them get in into the city life enjoying a good and prosperous life and will be the upholstery and the beginning of the measures behind.Secondly, I propose the reemployment and placement of the off-land peasants. The safeguard of employment power of them and make them reemployment is the fundamentally key of their long-term livelihood and social security. In this part, I also describe how to guarantee their reemployment in detailed way, for example, consummate the training system, create job opportunity, and give preferential policy and so on.Next, I suggest the government should establish and lead the social security system for off-land peasant. This part points out the detailed explanation of problems, solutions, principles and formations of the construction of social security system.Last, I ponder the measure of off-land peasants' problems in legal angle. According to the legislation, the revision of existing law, the legalization of each important system, we could consummate the safeguard measures for the rights of off-land peasant.
