Administrative participation is the result of the shifting of the global democratization from political democracy to administrative democracy, which is of great significance to the promotion of administrative democratization. Along with China's economic development and social transformation, and improvement of people's subject awareness, it is in greater and greater demand of a wide variety of forms of expression, communication, and negotiation of institutionalized arrangements, so the rise of the concept and practice of administrative participation is just in response to this demand. At present, administrative participation in China has been encouraged from top down and pushed from bottom up. In the face of the rise of administrative participation, this paper attempts to analyze the obstacles of administrative participation in China by looking into its legitimacy and the foreign legal system, explore the reform of administrative participation from the perspectives of ideology, culture, legal system, and social foundation, taking a theoretical try in improving the administrative participation in China.This article is divided into five sections. Introduction part of the proposed article, the author of the study and practical significance of the theoretical significance, summarized the results of previous studies and research framework of the idea of the article.The second part of administrative participation in the theoretical foundation. The author introduces the theory of participatory democracy and history; from the constitutional, procedural and human rights dimensions of the three set out the legal basis to participate in the executive; to define its concept and connotation, and to distinguish between the different characteristics of political participation, and in its assessment of the chief of the rule of law value and function for the executive to participate in research carried out to establish the value of the goal to provide theoretical support.The third part of administrative participation in the study of extra-territorial. In addition, the author also discussed the awareness of the cultural, social and scientific and technological basis for development of the reform package, designed to further promote China's participation in the administrative mechanism to enhance its effectiveness.
